Terms and conditions

The contract terms, exactly as you sign them at reception.

Contract terms of “Fit2010”, self-service sports centre. They form an integral part of the contract signed at reception.

1. Self-service

“Fit2010” is a self-service sports centre. “Fit2010” provides all the necessary machines during the posted opening hours. Use of the facilities and equipment is limited to the duration of this contract and is at the client’s own risk. Fit2010 accepts no liability.

2. Surveillance

The “Fit2010” studio is under permanent video surveillance.

3. Member’s autonomy

The member confirms being familiar with the operation of the machines and able to train with them independently and without supervision. Otherwise, the member may engage a trainer (CHF 45.– per lesson) for an introduction.

4. Use of the equipment

The machines must be used as intended and the seats must be covered with a towel. Excessive or disturbing noise is to be avoided.

5. Accompanying persons

Being accompanied by other people or by children is not permitted.

6. Access card

Misuse of access cards (passing the card to a third party) may result in immediate exclusion without notice and without refund. A complaint for unlawful entry will be filed and administrative costs will be charged (CHF 513.–).

7. Care of the equipment

The member undertakes to use the equipment and furnishings with care and to avoid any damage to the material. Damage caused deliberately will be invoiced.

8. Valuables and absences

The “Fit2010” studio accepts no responsibility for the loss of valuables (such as money, clothing or other items). Not using the activities provided for in the contract gives no right to a refund or a reduction of the fee and has no effect on the duration of the contract. In the event of an accident or serious illness, the months lost will be credited at the end of the membership year, provided that during that time the membership card and a medical certificate (for inability to practise sport) were handed in at reception.

9. Duration and cancellation

The Fit2010 contract is concluded for a term of 12 months. Cancellation of the contract (by letter, registered letter or email) is possible each year for the end of the contract or of the membership year, observing the notice period of 30 days before the contract expires. A confirmation of your cancellation will be sent to you 14 days after your cancellation. Contact the office if you have not received a reply within that period. Without this confirmation, your cancellation is not valid. Cancellation by word of mouth, SMS or WhatsApp is not accepted.

10. Renewal

The contract is tacitly renewed each year for a further year if the contracting party has not cancelled the contract in writing 30 (thirty) days before its expiry.

11. Late payment

If the member is in arrears with the monthly payments for one or more months, “Fit2010” is entitled to demand the payments due or the payments remaining until the end of the contract, or to withdraw from the contract; the membership card will be blocked.

12. Studio rules

The rules posted and communicated by Fit2010 form an integral part of the contract.

13. Illness, accident, military service

In the event of illness, accident or military service, you continue to pay the monthly instalments. If you hand in your membership card together with a medical certificate or marching orders at reception (submitted no later than one month after the accident, the start of the illness or the start of military service), the time lost will be credited to you as additional time at the end of your membership year.

14. Free months

Any free months (for customer acquisition, promotions, time credits for illness, holidays or military service, etc.) have no influence on the fixed date on which the contract was established, and therefore none on the notice period.

15. Refunds

Refunds will be granted only with an open-ended exemption supported by a medical certificate. The medical certificate must be sent to Fit2010 (no later than one month after the accident or the start of the illness). In that case, only half of the monthly instalments will be invoiced or refunded, after deduction of a fee of CHF 80.–. Medical certificates submitted later will no longer be accepted.

16. Moving house or leaving Switzerland

In the event of moving house (a radius of more than 30 km) or leaving Switzerland, from the second membership year onwards: only half of the months outstanding at the time of the move will be invoiced or refunded, after deduction of a fee of CHF 80.–, provided the client produces a copy of the residents’ register (registration in the new municipality or departure from Switzerland). The first year’s membership will be invoiced in full.

17. Reminders

A fee of CHF 15.– will be charged for reminders.

18. Contract transfer

For any transfer of a contract (possible from the second membership year onwards), a fee of CHF 45.– will be charged.

19. Pandemic

In the event of a pandemic, months lost due to a closure ordered by the cantonal or federal authorities will not be refunded or deducted from the invoice, but added to the end of the membership year as a “free” extension. If the membership contract has not been cancelled in accordance with the contractual terms, the membership continues after that free extension.

20. Minimum amount for refunds

Any refund will be made only for an amount greater than one year (CHF 468.–). A lower amount will in all cases be settled with a voucher.

21. Place of jurisdiction

The competent court is Fribourg or Neuchâtel respectively.
